Order and Payment Details:
No refunds of deposits will be issued after 3 days from the date of purchase.
Required Deposits based on Order Type: A stock order requires a minimum deposit of 25%. For special order merchandise and design work, a minimum deposit of 50% is necessary. Payment in full is required for floor samples, clearance items, "take with" products, and direct shipments.
With approved financing, required deposits are as follows: a 25% deposit for special orders, and a deposit equivalent to sales tax for all other types of sales.
Showroom or Warehouse Pick Ups, Window Treatments, and Design Work do not qualify for financing.
If you are purchasing a FLOOR SAMPLE, you agree that all the items are non-cancellable, non-returnable, and non-refundable. ALL SALES ARE FINAL, and items are non-serviceable.
Non-clearance priced ACCESSORIES may be returned to the store within 24 hours for a full refund. Tags must be attached.
SPECIAL ORDERS are non-cancellable, non-returnable, and non-refundable.
In our desire to better serve you, please be aware that arrival times for DOMESTIC SPECIAL ORDERS are approximately 8-12 weeks. Arrival times for IMPORTED SPECIAL ORDERS are approximately 16-30 weeks. All arrival times are approximate and subject to change due to market conditions.
The estimated delivery date provided to you at the time purchase is based on manufacturer’s lead times. As a result, Baer’s Furniture Co. Inc. cannot be responsible for manufacturer changes in delivery dates, and as such, Baer’s Furniture Co. Inc. will not offer any compensation for delayed merchandise.
Orders must be paid in full prior to scheduling delivery.
Stock Orders entered with less than a 25% deposit will be treated as a layaway. Prices will be guaranteed for 9 months, but inventory will not be held.
Checks must be received 7 business days prior to the delivery date.
A returned check fee will apply for any returned checks.
We have a 30-day price guarantee that ensures we will honor any price changes within 30 days of your delivery. All price adjustments will be issued as a store credit. Once the buyer takes possession of the merchandise, this credit can be used towards any future purchase of furniture, accessories, or rugs.
A storage fee of 5% of the total purchase price shall be applied for any orders held over 9 months. Any order held over 12 months will be cancelled, and all monies held for said order shall be forfeited to Baer’s Furniture Co. Inc. unless previous arrangements are made and accepted by Baer’s Furniture Co. Inc., in writing. After 12 months, Baer’s Furniture Co. Inc. cannot honor the original purchase price.
Delivery Policies:
Baer’s Furniture Co. Inc. offers white-glove delivery. This includes the delivery and setup of the furniture, as well as the removal of all packing materials from the furniture we deliver.
Some exclusions may apply to white-glove delivery. Exclusions include, but are not limited to, accessories, floor samples, and open items.
Customer must have possession of the home before a delivery date can be set.
The customer is responsible for verifying building access and ensuring furniture will fit through doorways, stairways, and elevators.
The space that the furniture is going in must be cleared before arrival. Please note that our drivers cannot move preexisting furniture in your home. Drivers cannot take old furniture out of your home except for mattresses &flat foundations. Drivers cannot take adjustable bases out of your home.
Due to insurance limitations, drivers are not allowed to install chandeliers, mirrors, paintings, or other items that require fastening to walls or ceilings.
Please be advised, if furniture is being brought upstairs, the first 3 floors are included in the delivery charge. Any additional floors up to the 6th floor will be a separate fee of $100 per floor, added to the delivery fee.
Delivery fees are quoted based on standard delivery circumstances within our delivery areas. While we make every attempt to ensure these quotes are accurate, additional fees may apply to circumstances, including long distance, high floor deliveries, limited access, and no-fit deliveries. The customer is responsible for communicating any potential issues to our scheduling or customer service teams prior to delivery to address any concerns.
A three-hour time window is provided the day prior to delivery. We are unable to request a specific time frame. Due to the possibility of unforeseen circumstances, this is an all-day appointment.

If the buyer or buyer’s agent is not at the delivery point or cannot accept delivery for any reason, a rescheduling fee of $199 will be required before the order can be rescheduled, unless the store is notified at least 72 hours in advance of the delivery date.
Carefully inspect your merchandise at the time of delivery. Damage, defects, or deficiencies must be noted on the Delivery Ticket. The driver will contact Baer’s Furniture Co. Inc. Customer Service to resolve any issues.
Baer’s Furniture Co. Inc. shall not be liable to the customer for any damages as a result of any delivery delays.
Financing terms shall commence on the first date merchandise is delivered.
Product Quality and Guarantees:
Merchandise is not guaranteed against fading, stretching, soiling, pilling, pile crushing, commercial use, or what Baer’s Furniture Co. Inc. considers to be excessive use.
Shedding and sprouting are natural characteristics of rugs. The manufacturer recommends vacuuming frequently using SUCTION ONLY.
Warranties vary by manufacturer. Please check the documentation that came with your furniture for your specific warranties.
Decisions on warranty claims are based on manufacturer guidelines. Wear and tear from normal use, excessive use, and/or abuse do not fall under the warranty and those claims will be denied at the discretion of Baer's Furniture and our furniture manufacturers.
You acknowledge that you have been offered Uniters’ Pure Furniture Five-Year Protection Plan. Any time before delivery, you may add Uniters' Pure Furniture Five-Year Protection Plan to all qualifying purchases. After delivery, the protection plan cannot be added.
Please inspect your merchandise carefully. Baer’s Furniture Co. Inc. is not responsible for any item picked up by you or your agent once it has left the showroom or warehouse.
Returns and Exchanges:
If you are not satisfied with your in-stock purchase, we may allow you to exchange the item within two weeks of receiving delivery. If the reselected item is less expensive than the original, the difference will not be refunded. The buyer will be responsible for any additional costs related to the new item. The item must be returned in new condition within two weeks of the original delivery. Additional delivery and pickup fees apply.
Mattress Comfort Guarantee: All Baer’s Furniture mattresses must be purchased with a bed protector at time of sale to be eligible for a Comfort Guarantee. A Comfort Guarantee claim may only be filed thirty (30) days after delivery of the mattress and no more than ninety (90) days post-delivery. The Comfort Guarantee allows for a one-time only reselection for a mattress of equal or greater value. The customer is responsible for the difference and a new delivery fee. The reselection of a mattress of lesser value will result in a store credit of the difference to Baer’s Furniture only. The Comfort Guarantee is for the mattress only. The Comfort Guarantee is only able to be used once: meaning that the mattress purchased in the reselection period does not qualify to be returned on those same standards. Foundations, adjustable bases, and sleep essentials are not included in the Comfort Guarantee program and are non-returnable, non-exchangeable items. There are no returns or refunds on any mattresses.
Power Bases, Foundations, and Sleep Accessories are non-returnable and non-refundable.
Special Orders, Rugs, Flooring, Custom Design, and Floor Samples are non-cancelable, non-returnable, and non-refundable.
All authorized refunds of payments made by credit card will only be credited to the originally charged credit card account.
Legal and Agreements:
For sales tax exemption, the customer must complete a Florida sales tax exempt card, or one must be on file at the store that this purchase is being made before being delivered.
The buyer will pay any attorneys’ fees and/or court costs incurred in the collection of unpaid balances, regardless of whether suit is filed, together with statutory interest.
Exclusive venue for any action relating to the enforcement or interpretation of this agreement shall be in the court of competent jurisdiction in and for Broward County, Florida.
The customer waives their right to a jury trial in any lawsuit relating to this agreement.
If any provision of this agreement shall be determined to be invalid or unenforceable for any reason, the remaining provisions of this agreement shall be unaffected thereby and shall remain in full force and effect.
This agreement shall be binding upon and shall inure to the benefit of the respective parties and respective administrators, executors, other legal representatives, heirs, successors, and permitted assigns.
No modification or waiver of any provision of this agreement shall be effective unless such modification or waiver is in writing and signed by all parties hereto.
This agreement constitutes the entire agreement between the parties and supersedes all prior verbal and written agreements between the parties.
The Parties agree that (i) no lawsuit or arbitration proceeding hereunder whether a CONSUMER DISPUTE or a BUSINESS DISPUTE shall be certified as a class action/collective action or proceed as a class action/collective action, or on a basis involving claims brought in a purported representative capacity on behalf of the general public, other customers or potential customers or persons similarly situated, and (ii) no lawsuit or arbitration proceeding hereunder shall be consolidated with, or joined in any way with, any other lawsuit or arbitration proceeding. THE PARTIES AGREE TO LITIGATE A CONSUMER DISPUTE OR BUSINESS DISPUTE ON AN INDIVIDUAL BASIS AND EACH WAIVES THE RIGHT TO PARTICIPATE IN A CLASS ACTION/COLLECTIVE ACTION.
